These reports provide with main information on SOGIESC references made by UN Committees in their Lists of Issues and Concluding Observations under countries' periodic review process, as well as on the General Comments and Individual Complaints that were adopted.

General comments

This section contains information about General Comments (General Recommendations) adopted by Treaty Bodies. These documents provide the Committees’ interpretation of the content of human rights provisions regarding thematic issues or methods of work.

on Article 21 of the ICCPR (the right of peaceful assembly)

 

Two references to SOGIESC:

●         States must ensure that laws and their interpretation and application do not result in discrimination in the enjoyment of the right of peaceful assembly, for example on the basis of […] sexual orientation and gender identity (para. 25).

●         Restrictions on peaceful assemblies should only exceptionally be imposed for the protection of “morals”. […] Restrictions based on this ground may not, for instance, be imposed because of opposition to expressions of sexual orientation or gender identity.  (para. 46).

Draft General Comment No. 25

on children’s rights in relation to the digital environment

 

●        Specific groups of children may require particular measures to prevent discrimination, […] this includes LGBTI children. […] This is because, for such groups, the digital environment may both provide unique access to vital resources, and also it may present heightened risks. (para. 12).

 

 

Individual complaints

This section contains information about decisions made by the Committees on individual complaints. An individual complaint is a formal complaint - from an individual who claims that their rights under one of the treaties have been violated by a State party - which most of the Treaty Bodies are competent to consider.
