Same-sex marriage will become legal in New Zealand on 19 August 2013. A bill for the legalisation was passed by the New Zealand House of Representatives on 17 April 2013, 77 votes to 44 in its third reading and received Royal Assent on 19 April 2013, with entry into force 4 months later to allow time for the Department of Internal Affairs to make the necessary changes for marriage licensing. New Zealand will be the first country in Oceania, and the second Commonwealth realm (after Canada), to allow same-sex couples to marry.

There is no ban on gays or lesbians serving in the armed forces. The Human Rights Commission Act 1977 (NZ), which established the Human Rights Commission, was amended in 1993 (coming into force in 1994), preventing the armed forces from discriminating against gays and lesbians wanting to serve in the armed forces. The Human Rights Commission administers the Human Rights Act 1993 (NZ), which prohibits sexual orientation discrimination [Human Rights Act 1993 (NZ), 21(m)].
