Si bien las relaciones entre varones o entre mujeres no están penalizadas,el código penal castiga con mayor dureza los actos homosexuales con menores,estableciendo una diferenciación entre el abuso de personas del mismo sexo yde sexos opuestos. En el articulo 138 tipifica el delito de ‘actos homosexuales con menores” que es penado con dos años de cárcel, frente a los actos heterosexuales que no son definidos de esa manera pero que son penados solo con multa.
Esta legislación ha sido aplicada de manera arbitraria para penalizar a los varones homosexuales adultos ya que la ley establece que la definición de actos sexuales queda a criterio del juez interviniente, y debe considerar a cualquier acto que provoque una respuesta erótica, por lo que una mirada ya puede ser considerada como tal.
Esta legislación no concuerda con la Constitución Nacional que declara en su articulo 46 “todos los paraguayos son iguales. No se admiten discriminaciones. El Estado removerá todos los obstáculos que impidan la plena igualdad de sus ciudadanos”. De esta manera, el orden constitucional es el que los activistas actualmente utilizamos para defendernos en casos de
discriminación.

Código Penal - Artículo 137

What is the full text of this law?
El Artículo 135 del Código Penal Paraguayo, que cubre el abuso sexual de menores, define "niño", a efectos de este artículo, como cualquier persona menor de 14 años (ver la cláusula octava). Los actos sexuales en general con un niño menor de 14 años se castigan con hasta tres años en prisión o una multa (cláusula primera). Las mismas penas se aplicarán cuando los actos sexuales son realizados por el adulto frente a un menor de 14 años o están dirigidos a éste, o cuando se induce al niño a practicarlo (con otro niño) frente a un adulto o con una tercera persona. En caso de penetración sexual ("coito"), la pena se agrava a entre dos y diez años en prisión (cláusula cuarta). Cuando el agresor es menor de 18 años, las acusaciones pueden retirarse (cláusula sexta).
Casamiento y adulterio.
Existe también en Paraguay otro crimen llamado estupro (Artículo 137), que se define como "sexo extramarital" (adulterio) practicado con adolescentes de entre 14 y 16 años. Este crimen se castiga con una multa y se aplica cuando uno de los involucrados está casado. Cuando el agresor es menor de 18 años, las acusaciones pueden retirarse.
El Artículo 137 del Código Penal dice: "El hombre que persuade a una mujer de entre 14 y 16 años a realizar el coito extramarital (relaciones sexuales) será castigado con una multa; Cuando el demandado es menor de 18 años, puede desestimarse la pena."
