DECRETO No. 56.-
EL PRESIDENTE DE LA REPÚBLICA DE EL SALVADOR,
CONSIDERANDO:
I. Que de conformidad al artículo 3 de la Constitución de la República, todas las personas son iguales ante la ley. Para el goce de los derechos
civiles no podrán establecerse restricciones que se basen en diferencias de nacionalidad, raza, sexo o religión;
II. Que El Salvador es Estado Parte de la Convención Americana sobre Derechos Humanos; del Protocolo Adicional a la Convención Americana
sobre Derechos Humanos en Materia de Derechos Económicos, Sociales y Culturales, "Protocolo de San Salvador"; del Pacto Internacional
de Derechos Civiles y Políticos y del Pacto Internacional de Derechos Económicos, Sociales y Culturales, mismos que determinan la
igualdad intrínseca de los seres humanos, consagrando así el principio de prohibición de toda forma de discriminación y teniendo derecho
a igual protección de la ley, adquiriendo los Estados Parte el compromiso de garantizar el ejercicio de los derechos que se enuncian en tales
Convenios Internacionales, sin discriminación alguna por motivos de raza, color, sexo, idioma, religión, opiniones políticas o de cualquier
otra índole, origen nacional o social, posición económica, nacimiento o cualquier otra condición social;
III. Que no obstante lo expresado en los considerandos anteriores, en El Salvador se observan aún situaciones que evidencian discriminación
y, en algunos casos, intolerancia hacia las personas por razón de su identidad de género y/o de su orientación sexual;
IV. Que es deber del Gobierno de la República velar por la generación de condiciones que permitan el desarrollo y protección de los ciudadanos
y ciudadanas del país, debiendo eliminarse al efecto las distintas formas de discriminación y de intolerancia hacia las personas y los grupos
sociales, por razones de su identidad de género y/o de su orientación sexual; propiciando por el contrario, acciones positivas al respecto;
habida cuenta que incluso, en la atención que la Administración Pública brinda a las personas en el cumplimiento de sus atribuciones, se
mantienen situaciones que evidencian lo expresado;
V. Que a tales fi nes, el Órgano Ejecutivo debe adoptar las medidas y regulaciones que fueren menester para evitar ese tipo de discriminaciones
en el seno de la Administración Pública, a fi n que se garantice el cumplimiento del precepto constitucional argüido en el presente Decreto y
las disposiciones de los Convenios Internacionales señalados, en los que se desarrolla la disposición constitucional de garantizar la igualdad
de las personas ante la ley, superando al efecto todo tipo de discriminación, al igual que los comportamientos inadecuados al efecto por
parte de la Administración Pública.
POR TANTO,
en uso de sus facultades constitucionales,
DECRETA las siguientes:
DISPOSICIONES PARA EVITAR TODA FORMA DE DISCRIMINACIÓN EN LA ADMINISTRACIÓN PÚBLICA, POR RAZONES
DE IDENTIDAD DE GÉNERO Y/O DE ORIENTACIÓN SEXUAL.
Art. 1.- Prohíbese en la actividad de la Administración Pública toda forma de discriminación por razón de identidad de género y/o de orientación
sexual.
Para efectos de lo dispuesto en este Decreto se utilizarán los conceptos y defi niciones siguientes:
ADMINISTRACION PÚBLICA: Todas las instituciones que integran el Órgano Ejecutivo, incluyendo sus organismos desconcentrados, así
como los organismos descentralizados adscritos a éste, independientemente de si realizan o no prestación de servicios al público.

ACTIVIDAD DE LA ADMINISTRACIÓN PÚBLICA: Cualquier actuación de carácter jurídico-formal, técnica o material, en modalidad de
acción u omisión, ya sea como ejecución de la ley, limitación de derechos, sanción administrativa o de cualquier otra naturaleza, realizadas por la
Administración Pública.
DISCRIMINACIÓN DIRECTA: La que es causada cuando una persona es, ha sido o puede ser tratada de manera menos favorable que otra en
situación análoga.
DISCRIMINACIÓN INDIRECTA: La que es causada cuando una disposición, criterio o práctica aparentemente neutros, sitúan a personas en
una determinada desventaja particular con respecto a otras personas; salvo que pueda justifi carse objetivamente con una fi nalidad legítima y salvo que
los medios para la consecución de esta fi nalidad sean adecuados y necesarios.
DISCRIMINACIÓN POR RAZÓN DE IDENTIDAD DE GÉNERO Y/O DE ORIENTACIÓN SEXUAL: Es toda distinción, exclusión o
restricción basada en la identidad de género y/o en la orientación sexual, que tenga por objeto o resultado la anulación, menoscabo o anulación del
reconocimiento, goce o ejercicio, en condiciones de igualdad, de los derechos humanos y libertades fundamentales.
Art. 2.- A los efectos de lo expresado en el presente Decreto, se prohibe a las instituciones y demás organismos que integran la Administración
Pública lo siguiente:
a) El incurrir en algún acto o práctica que de manera directa o indirecta constituya una forma de discriminación por razón de la identidad de
género y/o la orientación sexual; y,
b) El fomentar, propiciar, defender o apoyar cualquier acto o práctica que de manera directa o indirecta mueva a la no aceptación de determinada
persona o grupos de personas que incluso, incite a la discriminación o a la práctica de acciones hostiles en contra de éstas, por razón
de la identidad de género y/o la orientación sexual.
Art. 3.- Los titulares de las distintas dependencias y organismos que integran la Administración Pública deberán implementar una revisión
exhaustiva de las políticas, programas y proyectos que les atañen, adoptando o proponiendo los correctivos necesarios, si en el diseño o implementación
práctica de los mismos se advierten actuaciones o prácticas que de manera directa o indirecta constituyan o puedan generar cualquier forma de
discriminación por razón de la identidad de género y/o la orientación sexual.
Uno de los criterios que utilizarán para la evaluación del desempeño de su personal será la observancia de las disposiciones del presente Decreto.
Art. 4.- Los titulares de las distintas dependencias y organismos que integran la Administración Pública deberán garantizar la generación de una
cultura de respeto y tolerancia dentro de las actividades que desarrollan tales dependencias y organismos, cualquiera que fuese la identidad de género
y/o la orientación sexual de una persona.
Art. 5.- A efectos de asegurar el cumplimiento a lo establecido en el artículo 3, inciso primero del presente Decreto, facúltase a la Secretaría de
Inclusión Social de la Presidencia de la República para que, en atención a las atribuciones que especialmente le confi eren el artículo 53-B, números
1) y 5) del Reglamento Interno del Órgano Ejecutivo, brinde el asesoramiento u orientación necesaria a las distintas dependencias y organismos de la
Administración Pública, la que podrá actuar por requerimiento del titular o de manera ofi ciosa.
Art. 6.- No será aplicable ninguna disposición reglamentaria, acuerdo, orden, instructivo, resolución o circular que al interior de la Administración
Pública pudiese generar o propiciar de alguna manera la discriminación de personas por razones de identidad de género u orientación sexual.

Art. 7.- El presente Decreto entrará en vigencia ocho días después de su publicación en el Diario Ofi cial.
