PETITION re: NGO Access and Participation Whereas the ECOSOC Committee on NGOs has rejected on January 23, 2006, the ECOSOC Committee on NGOs summarily rejected theevery applications for consultative status of NGOs which address human rights violations directed against lesbians, gays, bisexuals and transgender people, specifically: the International Lesbian and Gay Association (ILGA), on January 23, 2006, LBL, and the Landsforeningen for Bsser og Lesbiske (LBL, the Danish National Association for Gays and Lesbians) without according either organization the chance to present its case, on January 23, 2006;; LSVD - the Lesbian and Gay Federation in Germany, on May 16, 2006, Whereas three other organisations advancing human rights for lesbians, gays, bisexuals and transgender people have applied for consultative status with ECOSOC and will shortly be considered by the NGO Committee (ILGA-Europe, on May 17, 2006. Whereas these rejections took place despite the objections of several States and, the Coalition Gaie et Lesbienne du Qubec, and LSVD - the Lesbian and Gay Federation in Germany); of CONGO (the Conference of Non-Governmental Organizations in Consultative Relationship with the United Nations) that the decisions had been taken on discriminatory grounds; Whereas questions of NGO access and participation are of significant concern for all NGOs, particularly during this time of UN transition and reform and transition; Therefore we, the undersigned NGOs, from all regions of the world and representing a broad range of human rights interests, emphasize the vital importance of upholding the following principles: (i) Due Process: The procedure used against LBL and ILGA (summary dismissal without any sort of hearing and with no reasons given for the dismissal), and the subsequent dismissal of the applications of LSVD and ILGA-Europe without legitimate reason, is a disturbing departure from usual practice. This summary and arbitrary procedure could in future be used against ANY NGO applying for ECOSOC status and is inconsistent with the basic requirements of due process; (ii) Freedom of Expression: It is crucial that NGOs addressing issues perceived to be controversial be heard inside the UN system. Indeed, the more unpopular or marginalised the human rights concerns being addressed, the more important it is that NGO voices be heard; (iii) Non-discrimination: Singling out for summary dismissal NGOs which advocate against discrimination based on sexual orientation or gender identity perpetuates that discrimination, and sets a dangerous precedent for all NGOs advocating respect for the human rights of vulnerable groups. We therefore call upon ECOSOC to direct overturn the refusal of the NGO Committee to grant consultative status to NGOs addressing the human rights of lesbian, gay, bisexual and transgender people, and to reconsider the applications of ILGA, and LBL, LSVD and ILGA-Europe on their merits, in accordance with usual practice, and to give full and fair consideration to the pending applications of ILGA-Europe, CGLQ and LSVD..
