Sex change not a ground for change of entries in civil registry

There is no law in the Philippines allowing for a change of name or sex in the civil registry by reason of sex reassignment. A transsexual underwent a sex reassignment surgery in Bangkok, Thailand. He lived as a woman and soon got engaged to an American.  Wishing to get married, he filed a petition for the change of his first name and sex in his birth certificate to make these compatible with his present sex.  The Regional Trial Court (RTC) granted his petition on the grounds of justice and equity.

The Republic of the Philippines, through the Office of the Solicitor General (OSG), appealed to the Court of Appeals (CA). It pointed out that there was no law allowing the change of the birth certificate entries by reason of sex reassignment. The CA reversed the RTC and dismissed the petition. Read more
